Google Beats Auto-Renewal Fee Suit In Calif. Appeals Court

Law360 (September 14, 2020, 9:22 PM EDT) — A California appeals court held Friday there is no private right of action under the state’s law prohibiting automatic, non-consensual service renewal fees when it affirmed a lower court’s decision to toss a proposed class action claiming Google Drive failed to fully outline its data storage fee policies.

Eric Mayron sued Google LLC in 2015 on behalf of the putative class, saying it violated California’s Business & Professions Code under its automatic renewal law and engaged in unfair competition.
