Counties Tell 9th Circ. VW Can’t Pause Anti-Tampering Dispute
Law360 (September 3, 2020, 5:18 PM EDT) — Two counties told the Ninth Circuit on Wednesday that Volkswagen has exaggerated the “irreparable harm” it would face if the counties are allowed to restart litigation claiming the German automaker’s use of emissions-cheating devices violated local anti-tampering laws.
Salt Lake County, Utah, and the Environmental Protection Commission of Hillsborough County, Florida, filed their opposition to Volkswagen Group of America Inc.’s recent motion to stay mandate, saying the U.S. Supreme Court will reject any petition for certiorari that Volkswagen plans to file, so their dispute should proceed on remand.
