DOJ Says Pot Study Fight Doesn’t Belong In 9th Circ.

Law360 (August 5, 2020, 10:27 PM EDT) — The U.S. Department of Justice has said that a medical marijuana research lab’s fight to reschedule the drug does not belong in the Ninth Circuit because the researchers had not exhausted their administrative review options.

In a brief filed Monday, the government pointed out that Scottsdale Research Institute and its president and principal investigator Dr. Suzanne Sisley were out of line when they sought judicial review of the U.S. Drug Enforcement Administration’s denial of a reschedule petition filed by other parties.

The department accused the SRI and Sisley of attempting to bypass the review procedures established by the Controlled Substances Act…
