Calif. Judge Says DOI’s Delay On Royalty Rule OK For Now

Law360 (July 31, 2020, 5:45 PM EDT) — A California federal court won’t force the U.S. Department of the Interior to immediately enforce an Obama-era rule tweaking royalty calculations for oil, gas and coal extracted from federal and tribal lands, saying the request is beyond the court’s power.

On Thursday, U.S. District Judge Saundra Brown Armstrong rejected conservation groups’ bid to force the Trump administration to set a deadline by which lessees must comply with an Obama-era rule changing the calculation of royalties for oil, gas and coal extracted from federal and tribal leases.
