CoreCivic Says Asylee’s Miscarriage Case Doesn’t Apply To It

Law360 (July 16, 2020, 6:51 PM EDT) — Private prison operator CoreCivic has asked a California federal court to dismiss claims brought against it by an asylum-seeker who miscarried in U.S. Immigration and Customs Enforcement detention, saying she does not have standing to pursue relief because she is not at imminent risk of being detained again.

The company said Wednesday that Rubia Mabel Morales-Alfaro’s suit should be tossed as it relates to CoreCivic, arguing among other things that she must show she was exposed to a “real and immediate threat” of a future injury at the time she filed her original complaint to recover any relief.
