Uber Misclassification Claims Likely To Survive, Judge Says

Law360, San Francisco (June 25, 2020, 10:12 PM EDT) — Uber drivers’ claims that the ride-hailing giant deprived them of benefits by misclassifying them as independent contractors are likely to survive dismissal efforts, a California federal judge said Thursday, the same day California’s attorney general sought a preliminary injunction to force both Uber and Lyft to reclassify drivers as employees.

U.S. District Judge Edward M. Chen said during a video hearing Thursday that while Uber drivers Christopher James and Spencer Verhines still needed to present “greater specificity” on their claim of entitlement to sick leave, he also said that “some things will likely survive dismissal.”
