Herman Miller Chair Trade Dress Rights Backed By 9th Circ.

Law360 (June 25, 2020, 11:17 PM EDT) — A split Ninth Circuit on Thursday agreed with a lower court that Office Star had willfully ripped off Herman Miller’s iconic Eames office chairs, ruling that the appearance of the chairs isn’t functional and they’re therefore entitled to trade dress protection.

However, while the Ninth Circuit majority affirmed the $3.4 million jury award for infringement of the Eames chair, it reversed a $3 million verdict on a dilution claim. And the three-judge panel also reversed the district court’s judgment on Herman Miller Inc.’s Aeron chair-related claims, finding that the district court had erred in its jury instructions on functionality.
