ConAgra Loses Bid For Coverage Of $102M Lead Paint Deal

Law360 (March 2, 2020, 5:05 PM EST) — A California judge has ruled that ConAgra’s insurers don’t have to pay its nearly $102 million share of a settlement in a suit over the widespread use of lead paint in the Golden State, finding that coverage is barred by a state law prohibiting insurance for intentional acts.

San Francisco Superior Court Judge Richard B. Ulmer Jr. granted summary adjudication Wednesday to more than 50 of ConAgra Grocery Products Co. LLC’s liability insurance carriers, including underwriters at Lloyd’s of London and units of Chubb Ltd. and CNA Financial Corp., while denying the food processing giant’s competing motion.
